What laws can be used to enforce internet blocks in Mexico?

In Mexico, the government uses various laws to enforce internet blocks. The Telecommunications and Broadcasting Law, the Federal Law on Protection of Personal Data in Possession of Individuals, and the Federal Law for the Protection of Consumers all include provisions that can be leveraged by the government to block websites and enforce takedowns.

The National Institute of Transparency, Access to Information, and Protection of Personal Data (INAI) is responsible for enacting these restrictions. It works alongside Mexican ISPs to ensure that internet users cannot access content considered harmful to national security or the peace, unfortunately, this may be used to censor content critical of the government. 

Additionally, Mexico has defamation laws that the government has used to suppress dissenting opinions and online speech. For example, the Federal Criminal Code includes laws that criminalize defamation and libel. These regulations have been used to single out and prosecute journalists, bloggers, and social media users critical of the authorities.

The Mexican government has also been accused of spying on activists and journalists by tracking their online activities using malware and other surveillance applications and tools. 

In 2017, for example, a Citizen Lab investigation revealed that the Mexican government purchased spyware from the Israeli technology company NSO Group to monitor human rights activists and journalists. 

As recently as 2022, Citizen Lab published ongoing evidence of abuses using the Pegasus Spyware, including hacking devices belonging to human rights defenders, members of government opposition, and journalists.

In addition, ISPs in Mexico ISPs are subject to the Federal Law on the Protection of Personal Data in Possession of Individuals (2019). This law forces ISPs to retain records of user browsing histories and metadata for at least two years. 

Finally, it is important to note that Freedom House also references the Mexican government’s use of violence and intimidation with impunity in order to silence dissenters and create a culture of self-censorship. This is hugely damaging to human rights and freedom of speech in the country.

What kind of internet blocks were previously enforced in Mexico?

The Mexican government is known to implement a number of different restrictions online. News articles and opinion pieces have been censored in Mexico. In addition, websites related to human rights and political activism have also previously been blocked. 

This censorship is imposed to prevent dissent and block access to coverage that criticizes the government, officials, or other public figures. In 2016 censorship of the press and violence against journalists led Reporters Without Borders to rank Mexico 149 out of 180 countries in the World Press Freedom Index.

Streaming services and social media websites such as Twitter, Facebook, Instagram, and YouTube also face blocks and overreaching takedown requests, particularly during election times and protests. In addition, the government has ordered ISPs to block torrenting sites, some gambling sites, and some adult sites that contain pornography.

These kinds of blocks highlight an ongoing culture of censorship in Mexico, putting citizens at risk. People in Mexico need VPNs to access unbiased news and educational resources, bypass propaganda imposed by the authorities, and maintain access to communication services, including social media during times of political upheaval. 

Is it legal to use a VPN in Mexico?

Yes. There are no laws in Mexico that make it illegal to subscribe to or use a VPN. Therefore, you are free to use a VPN. That said, it is worth noting that using a VPN to attempt to conceal online crimes is still illegal, and you could be prosecuted. This includes using a VPN to access or share copyrighted content.
